Plea Bargaining Cases: Legal Advice and Outcomes

Plea bargaining is not just a back-room negotiation. It is shaped by decades of court rulings that define what a fair deal looks like and what your lawyer is required to tell you. A few landmark cases explain why competent advice during a plea matters so much, and what can go wrong without it.

The Rulings That Shaped Plea Deals

Several U.S. Supreme Court decisions set the ground rules that apply in Georgia courtrooms too.

Lafler v. Cooper, 566 U.S. 156 (2012), concerned ineffective advice that led a defendant to reject a plea offer. Missouri v. Frye, 566 U.S. 134 (2012), concerned favorable formal offers that counsel did not communicate. Both address effective assistance during plea negotiations; relief also depends on proving prejudice.

North Carolina v. Alford, 400 U.S. 25 (1970), upheld acceptance of a voluntary, intelligent guilty plea despite an assertion of innocence where the record strongly supported guilt. The decision does not require every court to accept such a plea.

Padilla v. Kentucky, 559 U.S. 356 (2010), requires counsel to advise noncitizen clients about deportation risk. Clear deportation consequences require correct advice; uncertain law requires a warning that criminal charges may have adverse immigration consequences.

How These Cases Affect Your Plea Decision

A plea can have consequences beyond the sentence. Discuss your concerns with counsel, including immigration issues. Padilla addresses advice to noncitizens about deportation risk; it does not establish a universal rule covering every possible consequence.
